Terms of service
Last updated: 6 November 2026
1. About these terms
These terms apply between Finvarix Ltd (company number 16660368, registered office St Andrews Road, Cambridge, CB4 1DL) (“Finvarix”, “we”) and the club that subscribes (“the club”, “you”). The service is for clubs and other organisations, not for consumers. By subscribing, or by using the service on a club's behalf, you accept these terms for the club.
2. The service
Finvarix is an online service that analyses a club's accounts and operational data, compares them with peer benchmarks and produces analysis, actions, scenarios and reports. We may improve and change the service over time, but we will not materially reduce what a subscribing club receives during a paid year.
3. Subscription and fees
The subscription is annual and paid in advance. The standard price is £3,999 a year excluding VAT. Founding clubs (the first 10 clubs to join the pilot) pay £999 a year excluding VAT, and keep that rate for as long as their subscription continues without a break.
The subscription renews automatically each year unless either side gives at least 30 days' written notice before the renewal date. We will remind you before each renewal. Email is enough for notice.
Invoices are payable within 30 days. Apart from the guarantee in section 5, fees are not refundable.
4. What the club provides
You provide accounts and the operational figures the service asks for, such as member numbers and rounds played, and you confirm you are entitled to share them with us. The analysis is only as good as the data: we rely on what you upload and do not audit it.
Keep your login details secure, and use the service only for your club's own purposes. Do not try to access other clubs' data or copy the benchmarks for resale.
5. The “worth more than the fee” guarantee
If your first report doesn't identify at least one action worth more than your annual fee, we refund you in full.
To claim:
- upload your accounts and the required operational data within 30 days of joining;
- email us within 14 days of your first report, saying the report did not meet the guarantee.
“Worth more than your annual fee” means the central value of at least one action in your first report is more than the annual fee you paid, excluding VAT. If it is not, we refund the fee in full within 14 days of your claim and the subscription ends. The guarantee applies once per club, to the first year.
6. Your data and the peer benchmarks
Your club owns its data. You give us the right to use it to provide the service to you, and to include it in anonymised, combined form in the peer benchmarks shown to all clubs. Your club is never named, and no other club can see your figures or work out which figures are yours. Anonymised, combined figures may be kept after your subscription ends, because they cannot identify your club.
When your subscription ends, we delete your club's uploaded data within 90 days. Ask us before then if you want a copy.
7. Data protection
Where your uploaded data includes personal data, the club is the controller and we are its processor. We will:
- process it only to provide the service and on your documented instructions;
- make sure our staff and contractors are bound by confidentiality;
- keep it secure with appropriate technical and organisational measures;
- use only the sub-processors listed in our privacy notice, including Anthropic for AI analysis, tell you before we add a new one, and let you object;
- help you respond to requests from individuals and to the ICO;
- tell you without undue delay if we become aware of a personal data breach;
- delete or return the data at the end of the service; and
- give you the information you reasonably need to show we meet these obligations.
This section is our data processing agreement for the purposes of Article 28 of the UK GDPR.
8. Not financial advice
Finvarix provides analysis and information to support your club's own decisions. It is not financial, accounting, tax, legal or investment advice, and it does not replace your accountant or auditor. Benchmarks are drawn from filed accounts and other sources; some are measured and some are modelled, and the service shows which. Values for actions and scenarios are estimates with ranges, not promises. Decisions remain the responsibility of the club and its committee.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.
Otherwise, we are not liable for loss of profit, revenue, savings or goodwill, or for any indirect or consequential loss. Our total liability in any 12-month period is limited to the fees you paid us in the 12 months before the claim arose.
10. Intellectual property
We own the service, the software, the benchmarks and the methodology. You may use the reports we produce for your club for any of your club's purposes, including sharing them with members and your bank.
11. Ending the subscription
Either side can end the subscription at the renewal date by giving notice as in section 3. Either side can end it straight away by written notice if the other materially breaches these terms and does not put it right within 30 days of being asked, or becomes insolvent.
12. Changes to these terms
We may update these terms. We will give you at least 30 days' notice of any change that matters to you, and changes will not apply to the current paid year without your agreement.
13. General
These terms are the whole agreement between us about the service. If any part is found unenforceable, the rest still applies. They are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
